Web App Terms and Conditions

Profesora Wojciecha Marii Bartla 19E, lok. LU46, 30-389 Krakow, Poland (Forge Labs, AuraVibe, Company, we, us, or our).

These Terms and Conditions govern access to and use of the AuraVibe web application, website features, account environment, subscription management tools, checkout flow, and related services available through auravibe.ai (collectively, the Web App).

By accessing or using the Web App, creating an account, completing age confirmation, linking a Telegram account, purchasing a subscription, or otherwise using any part of the service, you agree to be bound by these Terms. If you do not agree, you must not use the Web App.

1. Service Scope

AuraVibe is a digital companionship platform operated globally by Forge Labs from Poland. The Web App is the control layer of the AuraVibe service and is designed for age-gated discovery, account creation, companion browsing, avatar management, checkout, billing, subscription changes, cancellation requests, support, and related account functions. The Web App is not the primary chat interface and does not provide the main real-time conversation environment.

AuraVibe's primary interaction environment is the mobile application, while Telegram may be offered as an optional supplementary channel. Access to any companion interaction outside the Web App remains subject to these Terms and any additional platform-specific rules communicated to the user.

2. Eligibility and Adult-Only Access

The Web App is intended strictly for adults. You may use the Web App only if you are at least 18 years old and legally permitted to access the service under the laws applicable in your jurisdiction. AuraVibe implements age-gating at the point of website entry before account creation, content access, and subscription activity.

By using the Web App, you represent and warrant that:

• you are at least 18 years old;
• all information you provide is accurate and complete;
• you are using the service only for lawful purposes; and
• you are not located in any jurisdiction where access to the service would be unlawful.

3. Account Registration

To access certain features, you must create an account. You agree to provide truthful, current, and complete information and to keep it updated. The Company may request or collect information such as your email address, username, Telegram ID, Telegram username, billing-related information, country, IP address, and other data reasonably required to provide and secure the service.

You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You must promptly notify AuraVibe at support@auravibe.ai if you believe your account has been accessed without authorization.

The Company may suspend, restrict, flag, review, or terminate accounts where there is suspected fraud, abuse, prohibited content activity, payment risk, evasion of prior enforcement, or any violation of these Terms.

4. Companion Content and AI Nature of the Service

AuraVibe is an AI-based service. Companions, outputs, messages, and interactions made available through the AuraVibe ecosystem are generated, assisted, filtered, ranked, or otherwise processed through automated systems, including a proprietary locally deployed language model and workflow controls.

You acknowledge and agree that:

• AI outputs may be fictional, simulated, incomplete, inaccurate, inconsistent, or unsuitable for certain uses;
• the service is provided for entertainment, companionship, and related lawful personal use only;
• AuraVibe does not guarantee factual correctness, emotional accuracy, uninterrupted availability, or any specific outcome; and
• you are solely responsible for how you use, interpret, request, generate, save, share, or rely on any AI-generated or AI-assisted content.

5. User Responsibility for Prompts and Generated Content

You are solely responsible for all prompts, instructions, uploads, requests, profile inputs, metadata, Telegram-linked activity, and any other content or actions originating from your account (User Inputs). You are also solely responsible for any text, images, outputs, scenarios, roleplay, derivative content, exported material, or other content generated, elicited, or shaped through your use of the service (Generated Content), to the fullest extent permitted by applicable law.

By using the service, you acknowledge and agree that AuraVibe provides an AI system subject to technical controls, but does not assume responsibility for unlawful, abusive, infringing, exploitative, or otherwise prohibited requests initiated by users.

You further agree that if you request, attempt to request, induce, test, probe, jailbreak, circumvent, or otherwise pursue prohibited content or prohibited behavior, you bear full responsibility for that attempt, regardless of whether the request is ultimately fulfilled, blocked, partially generated, intercepted, or logged.

6. Prohibited Conduct and Zero-Tolerance Enforcement

AuraVibe maintains a strict zero-tolerance policy for prohibited content and prohibited conduct. The following are strictly forbidden:

• any content involving minors, or any attempt to sexualize, depict, roleplay, exploit, or normalize minors in any way;
• child sexual abuse material, child exploitation material, or any similar unlawful or abusive content;
• non-consensual sexual content, coercion, rape scenarios, exploitation, abuse, blackmail, or forced acts;
• content involving real persons without consent, including non-consensual likeness use, deepfake-style misuse, or sexualized depictions of identifiable people;
• incest, trafficking, sexual violence, extreme abuse, or exploitative harm;
• content promoting, depicting, facilitating, or instructing violence, self-harm, illegal acts, fraud, hacking, evasion, or other criminal conduct;
• attempts to bypass safety mechanisms, filters, moderation systems, age gates, billing controls, bans, or account restrictions;
• use of the service to harass, threaten, defame, stalk, impersonate, exploit, or violate the rights of any person;
• infringement of intellectual property, privacy, publicity, or other third-party rights; and
• any other activity that violates applicable law, payment provider rules, platform rules, or these Terms.

7. Subscription Plans and Billing

AuraVibe operates a subscription-based business model denominated in USD, with paid conversion initiated through web checkout. The business plan describes monthly and annual billing options and a structured multi-tier pricing model, while the current commercial setup for the Web App may offer monthly subscriptions only until additional billing configurations are launched.

Paid features, benefits, access scope, avatar limits, and subscription prices displayed at checkout, on pricing pages, or in the account dashboard form part of the commercial terms applicable to your purchase at the time of order.

You authorize AuraVibe and its chosen payment service provider (PSP) to charge the applicable subscription fees, taxes, and other disclosed charges using the payment method you provide.

8. Renewals, Cancellation, and Changes

Unless otherwise stated at checkout, paid subscriptions renew automatically for successive billing periods until cancelled. You are responsible for reviewing the price, renewal cycle, and plan details presented before purchase.

At this stage of the Web App, cancellation and account deletion requests are handled through support rather than through fully self-serve dashboard cancellation. To request cancellation, you must contact support@auravibe.ai from your registered account email or through another verification method required by support.

AuraVibe may modify, suspend, replace, or discontinue plans, pricing structures, features, or payment providers at any time, provided that changes will not retroactively alter amounts already paid for the current committed billing period unless permitted by law or accepted by the user.

9. Refund Policy

Refunds are handled on a case-by-case basis. Submitting a refund request does not guarantee a refund.

If you believe you were charged incorrectly, you should contact support@auravibe.ai promptly before initiating a chargeback, so that the issue can be reviewed and, where appropriate, resolved directly.

Nothing in these Terms limits any non-waivable statutory rights you may have under applicable consumer law.

10. Support, Communications, and Notices

AuraVibe may send you service-related emails and notices about your account, billing, renewals, security, support matters, policy updates, and operational changes. You agree that such notices may be delivered electronically, including by email, in-product messages, or dashboard notifications where available.

11. Intellectual Property and Service Rights

The Web App, the AuraVibe name, branding, interface elements, software, databases, prompts, systems, moderation rules, catalogs, text, graphics, workflows, and all related technology and content, except to the extent owned by users or third parties, are owned by Forge Labs or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, AuraVibe grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Web App for personal, lawful, non-commercial use.

12. Availability, Moderation, and Service Changes

AuraVibe may update, improve, restrict, or discontinue any feature of the Web App at any time. The service may be unavailable due to maintenance, moderation actions, technical failure, infrastructure changes, security measures, third-party outages, or product evolution.

AuraVibe may monitor, review, filter, log, analyze, or preserve account activity, technical events, prompts, outputs, and related metadata where reasonably necessary for service delivery, security, billing integrity, moderation, legal compliance, fraud prevention, dispute handling, or enforcement of these Terms.

13. Disclaimers

To the fullest extent permitted by law, the Web App and related services are provided on an as is and as available basis. AuraVibe disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, title, or that outputs will meet your expectations.

AuraVibe does not warrant that the service will be uninterrupted, error-free, always safe, fully secure, or free from delays, omissions, or content errors.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Forge Labs and its directors, officers, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, data, goodwill, or opportunities arising out of or related to the Web App, the service, AI outputs, user conduct, moderation decisions, payment events, subscription termination, or reliance on any content.

To the fullest extent permitted by law, AuraVibe's aggregate liability for claims arising out of or relating to the service shall not exceed the greater of (a) the amount paid by you to AuraVibe for the service in the three months preceding the event giving rise to the claim, or (b) USD 100.

15. Indemnity

You agree to defend, indemnify, and hold harmless Forge Labs and its affiliates, personnel, and service providers from and against any claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to your use of the service, your User Inputs, Generated Content, violation of these Terms, violation of law, infringement of third-party rights, or prohibited conduct undertaken through your account.

16. Termination

You may stop using the Web App at any time. Account deletion requests are handled through support and may require verification.

AuraVibe may suspend or terminate access immediately if you breach these Terms, create risk for the Company or third parties, trigger moderation enforcement, initiate prohibited content activity, fail to pay applicable charges, or expose the service to legal, payment, or security risk.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except where mandatory consumer protection rules in your country of residence apply and cannot be excluded.

Any dispute arising out of or relating to these Terms or the Web App shall be subject to the jurisdiction of the competent courts in Poland, unless mandatory law provides otherwise.

18. Changes to These Terms

AuraVibe may update these Terms from time to time to reflect legal, technical, operational, product, or commercial changes. Updated Terms become effective when posted, unless another date is stated.

If required by law, material changes will be communicated through appropriate notice. Continued use of the service after the effective date of revised Terms constitutes acceptance of the revised Terms.
